Rental Requirements
Please review the following items that are required for all STRs on Beech Mountain. Use this checklist to ensure you are compliant with the Code.
Rental Affidavit of Compliance (§ 95.30)
The owner of each rental property shall submit an affidavit supplied by the Town affirming an annual inspection of all fire extinguishers, carbon monoxide alarms, and smoke detectors required by this subchapter. The affidavit must be submitted by January 1st of each calendar year. Failure to adhere to an affidavit can result in criminal penalties.
Occupancy Tax Listing Form (§ 31.11)
All persons, firms, owners, and property managers shall be required to register rental property with the Town Tax Administrator. The Town shall provide forms which shall be completed in full and shall include the name and address of the property owner, the physical address of the property, the name and address of the property manager (if any), federal tax identification number, and such other information as deemed appropriate by the town Tax Administrator. The listing form is due on May 30th AND again on November 30th of each year.
Occupancy Tax Monthly Report (Info)
Occupancy tax report forms are due with payment on or before the 15th of every month. Any report received after the 15th will be considered late and a late fee will be assessed. The form must be sent in every month even if there were no rentals for that month.
Smoke Detectors (§ 95.21)
All rental dwelling units shall have operable smoke alarms as prescribed by the NC State Building Code. At a minimum, there shall be a smoke detector:
- In each sleeping area (bedroom)
- In the immediate vicinity outside each sleeping area
- On each level of the dwelling (including habitable basements and attics)
- In cooking areas such as kitchens
- In garages
Carbon Monoxide Detectors (§ 95.23)
All rental dwelling units shall contain at least one operable carbon monoxide alarm and shall be installed the numbers and locations as prescribed by the NC State Building Code. At a minimum, there shall be a carbon monoxide detector:
- In the immediate vicinity outside each sleeping area
- In any room containing a fuel-fired appliance or fireplace
- In garages
Fire Extinguishers (§ 95.22)
All rental dwelling units shall provide at least one fire extinguisher per level installed in accordance with the NC State Fire Code, Section 906. Fire extinguishers shall be wall mounted on hangers or brackets located in a conspicuous, easily accessible location and not obstructed or obscured. Fire extinguishers should not be placed in concealed areas, such as under the kitchen sink.
Landline Telephone (§ 90.04)
All rental dwelling units shall install, have, and maintain a land line telephone capable of dialing 911 despite power outages.
Bear Resistant Receptacle (§ 50.11 J)
All residential rental dwelling units operating within the Town are required to utilize and maintain in good working order a bear resistant container or containers on the premises used for such rental adequate to hold the amount of waste generated by the property. The receptacle shall be specifically designed and marketed by its manufacturer as being bear proof or bear resistant by virtue of containing qualities and features specifically designed to prevent bears from accessing its contents and meet the requirements of § 50.12 B.
Rental dwelling units located in a multi-family building shall use the dumpster container provided by the property management.
